Please read these Terms of Service carefully before using the Fixel website and our pool fence repair services (the "Service") operated by Fixel.

1. Agreement to Terms

By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.

2. Services Provided

Fixel provides professional pool fence repair, maintenance, and related advisory services. All services are subject to an initial assessment, a detailed quote, and mutual agreement between Fixel and the client.

3. Quotes and Pricing

All quotes provided by Fixel are valid for a period of 30 days from the date of issuance. Prices are subject to change if the scope of work changes or if there is a significant change in material costs after this period. A deposit may be required before work commences.

4. Scheduling and Cancellations

Service appointments are scheduled based on mutual agreement and availability. Clients are requested to provide at least 24 hours' notice for any cancellation or rescheduling. Failure to do so may result in a cancellation fee.

5. Workmanship Warranty

Fixel warrants its repair work against defects in workmanship for a period specified in your service agreement, typically 90 days, unless otherwise stated. This warranty does not cover damage caused by misuse, neglect, acts of nature, or by other contractors. Material warranties are passed through from the manufacturer.

6. Client Responsibilities

Clients are responsible for:

• Ensuring safe and clear access to the work area.
• Providing accurate information regarding existing damage or previous repairs.
• Adhering to any instructions provided by Fixel for post-repair care or maintenance.
• Obtaining any necessary permits or approvals required for fence repairs in their locality, although Fixel can assist with guidance if requested.

7. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Fixel, its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

8. Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of North Carolina, United States, without regard to its conflict of law provisions.

9. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
